Workers’ Compensation is a form of insurance that offers crucial benefits to police officers who are injured or become ill in the line of duty. When an officer is hurt while performing job-related responsibilities, Workers’ Compensation may cover medical expenses and provide partial wage replacement during recovery.
The Workers’ Compensation system provides important protections, but navigating the process can be difficult—especially when an injury is serious or symptoms persist. Insurers may pressure injured officers to return to active duty before they are physically or mentally ready.
An experienced Workers’ Compensation lawyer for police officers from our firm is here to help push back against any hassles from the insurance company. At Gross & Kenny, LLP, we understand the challenges law enforcement professionals face and will not let an employer or their insurer take advantage of you. Our skilled attorneys have extensive experience representing injured workers, including first responders, and helping them secure the benefits they need to move forward. Call today to get started.
Pennsylvania Law requires almost all employers to offer Workers’ Compensation benefits to their employees, including law enforcement agencies. The main exceptions are certain federal officers or specialized roles with coverage under other programs. Officers cannot opt out of Workers’ Compensation unless their religious beliefs prevent participation.
Workers’ Compensation covers your medical care when you suffer a work-related injury or develop a job-related condition. The injury or illness could be directly tied to police duties but need not be. Examples of covered conditions include:
Almost any injury, illness, or long-term health issue that arises during your duties as a police officer could qualify for Workers’ Compensation benefits.
You must see a department-approved physician for initial care, but if your condition persists, you may choose your own provider after 90 days. If surgery is recommended, 77 Pennsylvania Statutes §306(f.1)(1)(i) gives you the right to seek a second opinion. Our Workers’ Compensation attorneys can help you change providers or arrange a second evaluation if needed.
If your injury is long-term or severe, your employer or insurer may require an Independent Medical Examination (IME). You are entitled to free medical care until you reach Maximum Medical Improvement (MMI)—the point at which further treatment is unlikely to help.
If your condition prevents you from working for at least seven consecutive days, you may qualify for temporary disability payments. Workers’ Compensation will typically pay two-thirds of your average weekly wage until your treating physician clears you for duty. If you can return on restricted duty, partial benefits may still be available.
When MMI is reached and full recovery isn’t possible, you may receive partial permanent disability based on your impairment rating. Compensation is calculated according to how much the condition affects your earning potential.
If your injury or illness leaves you permanently unable to serve as a police officer, you may qualify for total permanent disability benefits. Many permanently disabled officers choose to receive compensation as a lump sum. Our attorneys can help negotiate a fair settlement on your behalf.
Disputes are common in claims involving law enforcement, particularly with long-term or psychological injuries. If you disagree with a diagnosis, return-to-duty recommendation, or benefit denial, you don’t have to accept it. Instead, speak with one of our seasoned Workers’ Compensation attorneys for police officers.
You can challenge low disability ratings or denied treatments. In some cases, insurance companies reject claims entirely, claiming the injury was not work-related or not severe. Gross & Kenny, LLP will fight on your behalf to refute these denials and pursue the benefits you’ve earned through your service.
If you’ve been hurt in the line of duty, you deserve strong legal representation from a firm that understands what’s at stake. A knowledgeable Workers’ Compensation attorney from our team can help you understand your rights, guide you through the process, and fight for the benefits you need to recover.
Our dedicated legal team has deep experience with law enforcement claims and a passion for protecting those who protect others. Call today to discuss your claim and take the next step toward recovery.
